Como objetivo primordial se busca que se situé la relación en cuanto a las variables de estudio de la CSJ situada en Lima durante el año 2021. Metodológicamente, es un estudio por su naturaleza de carácter básico, desarrollándose bajo un modelo cuantitativo dentro de los lineamientos de diseño: no experimental, aplicando un cuestionario de preguntas para el recojo de información sobre una población muestral conformada por 81 personas entre los que destacan profesionales y personas que laboran en ámbitos jurisdiccionales, llegan a que se obtenga datos para los resultados mostrando la existencia de un medio de relación significativo, directo y alto rho = 850** entre cada variable de estudio. En ese sentido, de dicho resultado se pudo inferir que cuanto mayor sea el índice de dictámenes de prisión preventiva, superior será los índices de vulnerabilidad al derecho de la presunta inocencia.
The main objective of the study is to establish the relationship between pretrial detention and the presumption of innocence in extortion crimes in the Superior Court of Justice located in Lima during the year 2021. Methodologically, it is a study by its nature of basic character, which was developed under a quantitative approach, within the guidelines of a non- experimental design, applying a questionnaire of questions for the collection of information on a sample population made up of 81 people among which stand out justice operators and legal professionals, obtaining as a result the existence of a significant, direct and high rho = 850** means of relationship between each variable of study. In this sense, it could be inferred from this result that the higher the index of pretrial detention rulings, the greater the degree of violation of the right to presumed innocence.
