Esta investigación tuvo como objetivo Determinar si la provocación pública a la orden policial incide en la necesidad de reforma del artículo 333 del Código Penal, Lima - 2021. Para ello, tuvo un enfoque cualitativo, básico mediante la teoría fundamentada. Asimismo, se contó con la colaboración de 6 especialistas, los cuales participaron en una guía de entrevista. Como resultado se obtuvo que la alarma social es un factor que incide en que la población debido a que ello provoca miedo, desconfianza, inseguridad de sus autoridades. Finalmente, como conclusión se obtuvo que se logró determinar que la provocación pública a la orden policial incide en la necesidad de reforma del artículo 333 del Código Penal, Lima – 2021; ya que, en base a lo vertido por los participantes, indicaron que en muchos casos el desenlace de las funciones de los agentes policiales no encuentra un respaldo en el artículo citado, ya que se evidencia un vacío legal y ello conlleva a que el accionar de los policías se encuentre limitado y no exista una adecuada determinación de castigos a los que incitan a la provocación y alteración al orden público.
The objective of this investigation was to determine if the public provocation of the police order affects the need to reform article 333 of the Criminal Code, Lima - 2021. For this, it had a qualitative, basic approach through grounded theory. Likewise, there was the collaboration of 6 specialists, who participated in an interview guide. As a result, it was obtained that social alarm is a factor that affects the population because it causes fear, mistrust, and insecurity of its authorities. Finally, as a conclusion, it was obtained that it was possible to determine that the public provocation of the police order affects the need to reform article 333 of the Penal Code, Lima - 2021; since, based on what was expressed by the participants, they indicated that in many cases the outcome of the functions of the police agents does not find support in the cited article, since a legal vacuum is evident and this leads to the actions of the police is limited and there is no adequate determination of punishments for those who incite provocation and disturbance of public order.
