“Ineficiencia de las medidas de proteccion y su relacion con el delito de feminicidio en la Corte Superior de Lima 2021”

Abstract

Lo que hoy en dia se quiere es poder reducir la violencia familiar en sus diferentes modalidades, asi como el feminicidio que dia a dia va en aumento, es por ello que en nuestro pais, el Gobierno conjuntamente de manera articulada con otros organismos de apoyo (Operadores de Justicia), al apreciar el incremento de la violencia, de acuerdo a las estadisticas, han visto a bien dentro del marco de la Ley Nro.30364, dictar Medidas de Proteccion en favor de la mujer y los integrantes del grupo familiar, con la finalidad de poder prevenir, erradicar y sancionar todo acto de violencia y abuso que se cometa en los integrantes del grupo familiar, razón por lo que nos llevó a realizar el presente trabajo de investigación con el fin y plan de saber si el Estado y sus operadores de justicia, vienen realizando una labor con efectividad, a fin de saber son realmente son eficaces o no frente a esta aflicción general.

El enfoque de esta Ley Nro.30364 “Ley para prevenir, sancionar y erradicar la violencia contra las mujeres y los integrantes del grupo familiar”, es que establece mecanismos, dispositivos, politicas de prevencion para todas las victimas, garantizando la reparacion del daño producido, lo cual dispone mediante las8medidas8de protección, la persecución, reeducación, y sanción de todos los agresores, a fin de tener una vida libre denviolencia, garantizando de esa manera los5derechos-fundamentales, para lo cual ha sido establecido diferentes principios rectores, los que se deben aplicar y hacer cumplir ejecutándose las mismas, cuando estas sean dictadas a través de los Juzgados de Familia.

Pues dicha Ley Nro.30364, es importante recalcar los principios rectores como el principio de igualdad y no discriminación, de interés superior del niño, de razonabilidad8y proporcionalidad1, así como los enfoques5de género, integralidad, derechos humanos, entre otros, los mismos que son de gran aporte para el ámbito de aplicación, y se debe tener en cuenta ellos, ya que en los últimos años ha ayudado a neutralizar casos de violencia familiar, pero también debemos sensibilizarnos en el tema, puesto que el número de feminicidios ha ido aumentando, y es lo que azota a nuestra sociedad, y es por ello que se realiza el presente trabajo de investigación, a fin de coadyuvar a una mejor eficacia de la ejecución8de las medidas de9protección ante dichos actos de9violencia y feminicidios.

What is wanted today is to be able to reduce family violence in its different modalities, as well as femicide that is increasing day by day, that is why in our country, the Government jointly articulates with other support organizations ( Justice Operators), upon appreciating the increase in violence, according to statistics, have seen fit, within the framework of Law No. 30364, to issue Protection Measures in favor of the woman and the members of the family group, with the purpose of being able to prevent, eradicate and punish all acts of violence and abuse committed against the members of the family group, which is why we were led to carry out this research work with the purpose and plan of knowing if the State and its Justice operators have been carrying out a job effectively, in order to know are they really are effective or not against this general affliction.

The focus of this Law No. 30364 "Law to prevent, punish8and eradicate violence against women and5members of the family group", is that it establishes mechanisms, devices, prevention policies for all victims, guaranteeingythe repair of the damage produced. , which provides through protection-measures, persecution, re-education, and punishment of all aggressors, in order to have a life free of violence1, thus guaranteeing fundamental rights, for which different guiding principles have been established, those that must be applied and enforced by executing them, when they are issued through the Family Courts.

Well, said Law No. 30364, it is important to emphasize the guiding principles such as the principle of equality and non-discrimination, the best interest of the child, reasonableness9and proportionality, as well as gender approaches, integrality, human rights, among others, the same that are of great contribution to the scope of application, and they must be taken into account, since in recent years it has helped to neutralize cases of family violence, but we must also become aware of the issue, since the number of femicides has increased increasing, and it is what plagues our society, and that is why this research work is carried out, in order to contribute to a better effectiveness of the execution of protection measures against said acts of violence and femicides.
