La presente investigación tuvo como objetivo general Identificar cómo es la labor de la ONG AIDA sobre el derecho ambiental ante el impacto de la minería ilegal en la región Andino-Amazónica, 2021. Así mismo en la metodología se aplicó un enfoque cuantitativo, de tipo básica y de nivel descriptiva, lo cual permite reconocer la relación que tiene ambas variables; la población y la muestra estuvo conformidad por 6 abogados y 10 practicantes de derecho que laboran en la ONG AIDA que trabajaron en el caso de la Cuenca Andina Amazónica. A los cuales se le aplicó un cuestionario que estuvo conformado de 32 preguntas, mediante el uso de la herramienta estadística SPSS, se pudo obtener los siguientes resultados, en donde un 56% señalo estar totalmente de acuerdo que la ONG impulsa el cumplimiento del artículo 37, el cual se relaciona con el cuidado del medio ambiente, además un 62% señalo estar ni de acuerdo ni en desacuerdo que la ONG impulsa programas y capacitaciones en base al artículo 37 para mejorar los niveles de desempeño ambiental. Teniendo como conclusión principal, que la labor de la ONG AIDA es activa en protección de los derechos ambientales en beneficio de las comunidades en el área en el que esta organización puede abarcar para protegerlo, en los cual también se observa que el impacto de la minera ha sido grave con diversas negligencias para el medio ambiente. Observándose una labor en incremento y con complicaciones por hacer respetar los derechos ambientales, por lo que se implementó la ley del SEIA y ley general del ambiente, logrando combatir adecuadamente los impactos de la minería ilegal.
The general objective of this research was to identify the work of the NGO AIDA on environmental law in the face of the impact of illegal mining in the Andean-Amazon region, 2021. Likewise, the methodology applied a quantitative approach, basic and descriptive, which allows recognizing the relationship between both variables; the population and the sample consisted of 6 lawyers and 10 law practitioners working in the NGO AIDA who worked in the case of the Andean-Amazon Basin. A questionnaire with 32 questions was applied to them, using the statistical tool SPSS, and the following results were obtained, where 56% indicated that they totally agreed that the NGO promotes compliance with article 37, which is related to environmental care, and 62% indicated that they neither agreed nor disagreed that the NGO promotes programs and training based on article 37 to improve the levels of environmental performance. The main conclusion is that the work of the NGO AIDA is active in the protection of environmental rights for the benefit of the communities in the area in which this organization can protect, in which it is also observed that the impact of the mining company has been serious with various environmental negligence. The SEIA law and the general environmental law have been implemented, and the impacts of illegal mining have been adequately combated.
