Prisión preventiva y su relación con derechos fundamentales en el Distrito Judicial Lima Centro - Lima 2020

Abstract

In the present investigation entitled: Preventive Prison and its relationship with Fundamental Rights in the Lima Centro Judicial District - Lima 2020; The main objective was to analyze the relationship between the independent variable Preventive Prison and the dependent variable Fundamental Rights. The focus of the study is quantitative, basic type, correlational level, non-experimental design without affecting the variables, and cross-sectional because it was carried out in the year 2020. Preventive detention has been the subject of controversies and legal and juridical conflicts, criticized as imprudence and abuse of authority by the defendants and that is why it becomes a legal, constitutional, and social problem that affects fundamental rights. The items are high grades on the Likert scale. The collection tool was validated by the experts and the result is 0.94%, which indicates that the tool has the best validity. The reliability of the instrument was performed according to Cronbach's alpha coefficient and efficiency scores of 0.644 for preventive detention and 0.668 for fundamental rights. Between the variables and the dimensions, the correlation was measured using Spearman's RHO coefficient, the value obtained is 0.00, that is, less than 0.05, and the correlation coefficient is 1.000, concluding that there is a very high positive relationship, rejecting the null hypothesis and the alternative hypothesis between preventive detention and fundamental rights in the judicial district of central lima - lima 2020 is accepted.

La presente investigación titulada: Prisión Preventiva y su relación con Derechos Fundamentales en el Distrito Judicial Lima Centro - Lima 2020; el objetivo principal fue analizar la relación que existe entre la variable independiente Prisión Preventiva y la variable dependiente Derechos Fundamentales. El enfoque del estudio es cuantitativo, de tipo básica, de nivel correlacional, de diseño no experimental sin afectar a las variables y de corte transversal porque se realizó en el año 2020. La prisión preventiva viene siendo objeto de controversias y conflictos legales y jurídicos, criticado como una imprudencia y abuso de autoridad por parte de los justiciables y es por ello se convierte en un problema legal, constitucional, social, que afecta los derechos fundamentales. Los ítems, son grados altos en la escala de Likert. La herramienta de recolección fue validada por los expertos y el resultado es de 0,94%, lo que indica que la herramienta tiene la mejor validez. La confiabilidad del instrumento se realizó de acuerdo con el coeficiente alfa de Cronbach y puntajes de eficiencia 0,644 para prisión preventiva y 0,668 para derechos fundamentales. Entre los variables se medió la correlación utilizando el coeficiente RHO de Spearman, el valor obtenido es 0,000, es decir, inferior a 0,05 y el coeficiente de correlación es de 1,000 concluyendo que existe la relación positiva muy alta, rechaza la hipótesis nula y se acepta la hipótesis alterna entre prisión preventiva y derechos fundamentales en el Distrito Judicial de Lima Centro - Lima 2020.
